New fencing statutes in Barbing: What landowners need to know!
On September 5, 2025, the municipality of Barbing passed the new fencing statutes. This decree is based on Article 23 of the Bavarian Municipal Code and Article 81 Paragraph 1 No. 5 of the Bavarian Building Code. The statutes are scheduled to come into force on October 1, 2025 and replace the previous statutes of February 9, 2017.
The regulations of the enclosure statutes apply to the entire area of the municipality of Barbing, although they only apply to areas with a development plan if there are no different regulations. A fencing is defined as a structure or other facility used to delimit property. However, living hedges, bushes and tree plantings are excluded from this.
Details on eligibility
The statute allows different types of enclosures. Open enclosures such as wooden fences, metal fences and wire fences are permitted. Closed enclosures, such as wooden walls and walls, must not exceed a height of 1.00 m. In addition, a closed-open ratio of over 50% is a criterion for classification as a closed enclosure.
In addition, fence bases must not exceed a height of 5 cm. Openings for small animals must be at least 10 cm high and 20 cm wide every 10 m or at least once per closed side of the property. The overall height of the fencing must not exceed 1.40 m, whereby this height is calculated from the adjacent ground surface of the neighboring property.
Privacy fences and terrace partitions between semi-detached houses and terraced houses can be up to 2.00 m high and 4.00 m deep. In order to ensure a uniform design, the enclosures must also meet the requirements of Article 8 of the Bavarian Building Code (BayBO), whereby bright colors are not permitted.
Prohibitions and administrative offenses
The use of barbed wire and NATO wire is prohibited according to the new statutes. Fines are possible for violations of Section 2 of the statutes. However, under certain conditions, deviations can be approved in accordance with Art. 63 BayBO.
