There are several key points on the agenda. This includes the approval of the public minutes of the market town council of July 14, 2025 and of the building and environmental committee of July 30, 2025. Changes to the parking space regulations
In the context of the garage and parking space statutes, numerous changes are planned, which will be adapted to the 2025 amendment to building law. These changes aim to municipalize the obligation to set up parking spaces and place it on a different legal basis. The existing statutes, which go beyond the Bavarian Garage and Parking Space Ordinance, must be adjusted by September 30, 2025 or they will expire. The parking space requirement applies to structural measures, changes and changes of use, but not to attic extensions or additions to residential buildings.
A key aspect of the new regulations is that the transfer fee for parking spaces can no longer be set freely, but is now tied to the costs of creating a parking space. For urban development projects, such as the planned residential area “Südlich der Buchenstrasse” in Markt Nittendorf, this means that the number of parking spaces will also be adjusted. If there are two residential units or more, a car parking space can also be used as a parking space for at least six bicycles, which is intended to promote a more sustainable mobility solution. Furthermore, under certain conditions, the parking space requirement can be fulfilled by a nearby property, with the decision on this being made by the Building and Environmental Committee.
Regional context and further developments
Since January 1, 2019, cities and municipalities in North Rhine-Westphalia have had the opportunity to determine the type and extent of parking spaces for motor vehicles and bicycles in construction projects. This regulation is based on an amendment to the NRW state building regulations and has significantly strengthened the municipal parking regulations. The guiding principle of these changes is that parking space regulations can be adapted to local conditions and municipal development strategies.
The revision of the model parking space regulations and the publication of updated guidelines show that practical experience has already been incorporated into the amendment. The new regulations offer municipalities more scope for individual solutions, which allows the implementation of traffic development measures to be optimized.
Finally, the announcement of the approved resolutions from the non-public meeting will also be on the agenda at the next meeting of the market town council. The council will also deal with various inquiries and topics in the “Miscellaneous” section, including the repayment of corona-related start-up financing by the municipal traffic monitoring in Upper Palatinate.
