On November 20, 2025, the Beratzhausen market town council announced a significant innovation: The 1st amendment to the corporate statutes for the municipal company KMB was issued on October 30, 2025. These statutes will take effect on the day after their publication, i.e. from November 21, 2025. The announcement was signed by Matthias Beer, the first mayor.

The statutes are laid down in the administration of the Beratzhausen market. Interested citizens have the opportunity to view the statutes in the Beratzhausen town hall, in the annex building, Marktstrasse 31, financial administration, room 1. Viewing is possible at the following times:

  • Montag, Dienstag, Donnerstag, Freitag: 07:30 Uhr – 12:30 Uhr
  • Donnerstag: 13:00 Uhr – 18:00 Uhr

Background to the company statutes

The legal basis for the establishment and operation of municipal companies is laid down in Bavarian law. According to the information from gesetze-bayern.de, the district is able to set up independent companies in the legal form of an institution under public law or to transform existing companies. This serves to fulfill municipal tasks and increase returns. A company can only be converted into a municipal company as long as there are no special rights of third parties.

The municipal company can also invest in other companies if this serves the specified corporate purpose. Important points in the company statutes include the definition of names, tasks and the number of board and administrative board members. The Articles of Association and any changes made must be published to be legally valid. The district has unlimited liability for the municipal company's liabilities if payment from its assets is not possible.

The inspection of the new statutes and the efforts to ensure transparency are in line with the provisions of Bavarian municipal law, which promotes the participation of citizens and the proper implementation of local political processes.
