Relevance of precaution

The diagnosis of dementia presents many affected families with major challenges and raises concerns about their future lifestyle. It is essential to discuss important decisions early on, particularly regarding representation in financial matters, care wishes and inheritance. These issues should be recorded in writing to avoid later conflicts. It is necessary to issue a power of attorney in a timely manner, as long as the person concerned is still legally competent, in order to ensure that a trusted person can make important decisions if this is no longer possible themselves. Information on this is provided in the Dementia Guide, which also explains that detailed regulations in such powers of attorney are important.

The power of attorney allows a selected person to act in the interests of the principal, for example in financial matters and medical decisions. The task and responsibility can be distributed among several people, although it can also make sense to register the power of attorney with the central pension register.

Care and patient directives

The care directive offers an important alternative to the power of attorney, especially if no trusted person is available or legal control is desired. It makes it possible to specify wishes for legal representation, even if the person concerned can no longer exercise all of their rights. In addition, specific wishes for medical measures can be recorded in a living will, which is particularly important for people with dementia. The regulations can concern both artificial nutrition and resuscitation measures.

In addition, it is advisable to regularly review the living will and update it if necessary to ensure that the patient's current wishes are taken into account. Dementia Aid Germany points out that even if the ability to make decisions is limited, there are still options for shaping the care order, which can expand the legal framework for those affected.
