Change in drainage fees: New statutes for Donaustauf!

On November 28, 2025, the Donaustauf market published an announcement that refers to the statutes for the first amendment to the contribution and fee statutes for the drainage facility (BGS-EWS). This regulation amends an existing statute that originally came into force on October 7, 2021. The announcement affects all citizens who live in Donaustauf or whose properties are connected to the drainage system. The change also points out that an unreadable or blank PDF document can be found under a specified link, which is relevant for those interested in obtaining comprehensive information. Donaustauf.de reports that the changes to the statutes were announced on time.

The changes in the statutes primarily concern the collection of fees and contributions for the drainage of wastewater and rainwater. In this context, the Bavarian State Ministry of the Interior issued a model statute for a contribution and fee statute for the drainage statute on May 20, 2008, which serves as a guide for municipalities that discharge wastewater and rainwater from properties. According to the specifications from Rechte-Bayern.de, the contribution and fee statutes must be enacted on the basis of the Municipal Taxes Act (KAG).

Drainage regulations

The model statute stipulates that adjustments are necessary if only dirty water is collected. Separate regulations must be observed when disposing of faecal sludge. A contribution and fee statute is necessary, which, among other things, offers alternatives for the contribution part and fee part, including proposals for fee statutes with and without basic fees. When it comes to stormwater fees, a key factor is the area of the connected properties.

According to Dejure.org, aerial photos may also be used to determine the areas when collecting rainwater fees. The KAG stipulates that the calculation of fees and contributions only takes into account the costs of property drainage and not the costs of draining public streets, paths and squares.

Important deadlines and scope

The statutes come into force one week after the announcement, which means that the previous statutes will cease to have effect during this period. The area of application of the new contribution and fee statutes must not be larger than that of the existing drainage statutes. When collecting contributions, it is taken into account whether the property is built-up, buildable or commercially used.

The proposed changes are designed to make wastewater disposal efficient and ensure that fees are charged fairly. The administration also has the responsibility to communicate the new regulations transparently so that all affected citizens can be informed accordingly.
